Can A Crisis of Confidence In Our State and Federal Judicial Branches Create Transformative Changes? And would ‘The Robes’ allow such restructuring to even occur?

“Where there is wrongdoing, we will address it. Where there was an abuse of power, we will stop it. Where our policies are deficient, we will change them. We want to know the truth. We recognize the branch faces a crisis of confidence in its leadership.”

-Chief Justice Brian Boatright, Colorado Supreme Court, State of the Judiciary Speech, The State House, February 18, 2021

As established in the United States Constitution, Our Right to Redress Grievances, whether it be individually, or by Class Action, is a Fundamental Part of American Democracy. Intervening for others whose Human Rights have been violated in various ways is paramount to the American Legal System just as well. ‘We The People’ should also be allowed to set precedent by Changing Unjust Laws. Isn’t this why Our Nation’s Forefathers attempted to establish a Fair and Impartial Legal System for us to utilize?

Many Years later-this process feels like it has been hijacked by those having Bureaucratic Influence. What about Governmental Officials that sway a behind the scenes influence over our State and Federal Courts Decision Process in certain cases? Has Our Nation’s Separation of Powers been compromised? And if so-can anything be done to change these Judicial Shortcomings by Common Americans? Sadly enough-reality tells us this can’t be done.

Where have these Original Constitutional Principles of American Democracy gone? And why are some (certainly not all) of its own participants-whether it be Practicing Attorneys, Government Peace Officers, like District Attorneys and Judges-well educated in legal ethics-Knowingly Undercut the Rule of Law? When these Judiciary missteps become public, why are they not corrected in some reputable manner? After all, doesn’t this coincide with the phrase ‘No one is Above the Law.’

Like so many other aspects in America, Our Judicial Process has to lost its way. This may be partly due to various Conflicts of Interest permeating within the Walls of Our Judicial Districts. Or could it be other subtle pressures, placed upon it from other outside Governmental Offices? After all, isn’t it our Governors and President who appoint Judges to serve on our District, Appellate and Supreme Court Benches?

Additionally, throughout Our Judicial Branches, can established relationships between judges and other high-ranking government personnel inappropriately influence some cases as they move through the judicial system? Are there those within the Judicial Branch who have to ignore Judicial Misconduct for fear of internal repercussions? How many Judges, and other court personnel, wishing to move up the Judicial Ladder look the other way in order to achieve their own professional aspirations?
